Welcome to DigitalXLR.com. These Terms of Service govern your access to and use of DigitalXLR, including our website, account system, video generation tools, AI prompt interface, credit system, paid plans, generated videos, and related services.
By creating an account, purchasing credits, submitting prompts, uploading files, generating videos, or using DigitalXLR in any way, you agree to these Terms. If you do not agree, you must stop using the Service.
DigitalXLR is an AI-powered video generation service that may use third-party AI models, infrastructure, and APIs, including Seedance 2.0 or other providers where available. These services may change, become unavailable, be replaced, or operate differently over time.
This document is a general template and should be reviewed by a qualified lawyer before publication.
1. Definitions
“DigitalXLR,” “we,” “our,” or “us” means DigitalXLR.com and its operator.
“Service” means the DigitalXLR website, platform, tools, AI video generation features, account system, payment system, credit system, and related services.
“User,” “you,” or “your” means any person or entity using the Service.
“Input” means any prompt, text, image, video, audio, reference file, instruction, or other material you submit to the Service.
“Output” means any AI-generated video, image, audio, text, preview, draft, file, or creative result produced through the Service.
“User Content” means your Input and Output together.
“Credits” means prepaid usage units, tokens, minutes, points, or similar balances used to access generation features.
“Third-Party Provider” means any external AI model, API, cloud service, payment processor, storage provider, moderation system, or infrastructure provider used by DigitalXLR.
2. Eligibility
You must be legally allowed to use the Service in your country or region.
If you are under the age of majority in your location, you may only use the Service with permission from a parent, guardian, school, or authorized adult.
You may not use the Service if you are banned from the platform, restricted by applicable law, or using the Service on behalf of someone who is not permitted to use it.
3. Account Registration
Some features require an account. You agree to provide accurate information when registering and to keep your login details secure.
You are responsible for all activity under your account, including prompts submitted, files uploaded, credits used, videos generated, and payments made.
You must notify us immediately if you believe your account has been accessed without permission.
We may refuse, suspend, or terminate accounts that violate these Terms, create risk for the platform, abuse the Service, or attempt to bypass platform rules.
4. Description of the Service
DigitalXLR allows users to generate videos and related creative assets using AI models and automated processing systems.
The Service may support text-to-video, image-to-video, video-to-video, prompt-based editing, reference-based generation, or other AI-assisted creative workflows depending on availability.
Generated results may vary. We do not guarantee that any Output will match your prompt exactly, be commercially usable, be free from errors, or meet your expectations.
DigitalXLR is provided as an AI creative tool, not as a guaranteed production studio, legal clearance service, copyright verification tool, or professional advice platform.
5. Third-Party AI Providers
DigitalXLR may rely on third-party AI systems and infrastructure, including Seedance 2.0 or other model providers.
You understand that third-party providers may change their models, pricing, safety rules, availability, speed, output quality, region access, API behavior, or commercial terms at any time.
If a provider becomes unavailable, changes its service, limits access, increases costs, blocks certain content, or stops operating, DigitalXLR may replace that provider with another model or service.
We do not guarantee permanent access to any specific AI model, including Seedance 2.0.
You agree that DigitalXLR is not liable for delays, failed generations, blocked prompts, reduced quality, provider outages, provider policy changes, or discontinued third-party services.
6. User Content and Rights
You retain any rights you already own in your Input.
Subject to applicable law and third-party provider terms, you may use your Output for personal or commercial purposes, as long as your use complies with these Terms, applicable law, intellectual property rights, privacy rights, publicity rights, and any provider restrictions.
DigitalXLR does not guarantee that Output is unique. Similar or identical results may be generated for other users.
You are responsible for reviewing Output before publishing, selling, advertising, or using it publicly.
You must ensure that your Input and Output do not violate the rights of any person, brand, creator, performer, company, platform, or rights holder.
7. License You Grant to DigitalXLR
By submitting Input or generating Output, you grant DigitalXLR a worldwide, non-exclusive, royalty-free license to process, store, transmit, display, reproduce, modify, and use your User Content only as needed to operate, provide, secure, improve, moderate, debug, and support the Service.
This license allows us to send your Input to third-party providers where required for generation, moderation, storage, payment processing, abuse prevention, or technical operation.
We will handle your data according to our Privacy Policy.
8. Responsibility for Input
You must only upload or submit content that you have the legal right to use.
You may not upload private, confidential, copyrighted, sensitive, or personal material unless you have permission and accept the risk of processing it through AI and third-party systems.
You are responsible for prompts, reference images, likenesses, voices, logos, brand assets, music, clips, scripts, and all other materials you submit.
You must not submit content that violates law, infringes rights, invades privacy, misuses someone’s likeness, or attempts to generate harmful, deceptive, abusive, exploitative, or illegal material.
9. Prohibited Content and Conduct
You may not use DigitalXLR to create, upload, request, distribute, sell, or promote content that is illegal, abusive, exploitative, harmful, infringing, deceptive, or unsafe.
This includes sexual content involving minors, non-consensual sexual content, explicit deepfakes, harassment, threats, hate content, terrorist or extremist promotion, instructions for wrongdoing, fraud, scams, impersonation, malware, doxxing, or content that violates another person’s privacy or rights.
You may not generate or distribute realistic depictions of real people in misleading, defamatory, sexual, political, criminal, or harmful contexts without proper consent and legal rights.
You may not use the Service to copy, imitate, reproduce, or create derivative works based on copyrighted characters, movies, games, shows, music, logos, brands, celebrities, influencers, or protected creative works unless you have permission or a valid legal basis.
You may not bypass safety systems, exploit bugs, abuse free credits, create multiple accounts to avoid limits, reverse engineer the platform, scrape the Service, attack our infrastructure, resell unauthorized access, or interfere with other users.
We may block prompts, refuse generations, remove content, suspend accounts, limit access, or report unlawful activity where appropriate.
10. AI Output Limitations
AI-generated content may contain mistakes, distortions, artifacts, false details, unexpected similarities, unsafe elements, or inaccurate representations.
DigitalXLR does not guarantee that Output is accurate, lawful, non-infringing, platform-safe, advertising-compliant, or suitable for commercial release.
You are responsible for reviewing, editing, clearing, and approving Output before use.
You should not rely on Output as legal advice, medical advice, financial advice, professional advice, factual proof, identity verification, or evidence of real events.
11. Credits, Usage, and Generation Costs
DigitalXLR may use credits, points, minutes, tokens, or similar balances to measure usage.
Credits may be consumed when you submit a generation request, start processing, receive a preview, export a file, upscale content, retry generation, or use premium features.
Generation costs may vary based on model type, duration, resolution, queue priority, input type, compute cost, provider cost, or feature selected.
Failed, blocked, incomplete, or unsatisfactory generations may still consume credits if processing resources or third-party provider costs were used.
We may adjust credit pricing, package sizes, usage rates, plan benefits, queue rules, and feature access at any time.
12. Payments and Billing
Paid features may require one-time payments, subscriptions, prepaid credits, or usage-based billing.
By purchasing from DigitalXLR, you authorize us and our payment processor to charge your selected payment method.
You are responsible for all applicable taxes, bank fees, currency conversion fees, payment processor fees, and charges related to your purchase.
Prices may change at any time. Price changes do not affect purchases already completed, unless required by law or stated in your plan terms.
13. Refund Policy
Unless required by applicable law, all payments are final and non-refundable.
This includes subscriptions, credit purchases, generation fees, unused credits, used credits, failed generations, blocked prompts, slow processing, provider outages, dissatisfaction with Output, account suspension caused by violation of these Terms, or changes to third-party model availability.
DigitalXLR may, at its sole discretion, offer credits, refunds, or adjustments for duplicate charges, verified billing errors, or major service failures.
Any discretionary refund or credit does not create a future obligation to provide similar refunds or credits.
14. Subscriptions
If DigitalXLR offers subscriptions, your subscription will renew automatically unless cancelled before the renewal date.
Cancelling a subscription stops future renewal but does not automatically refund the current billing period.
Subscription benefits may include credits, priority generation, model access, storage, export options, or other features. These benefits may change over time.
Unused subscription credits may expire according to the plan terms shown at purchase.
15. Storage and File Availability
DigitalXLR may store generated videos, uploaded references, project files, previews, or exports for user convenience.
We do not guarantee permanent storage. Files may be deleted, compressed, limited, expired, unavailable, or removed due to storage limits, account status, policy violations, technical issues, or business changes.
You are responsible for downloading and backing up your own files.
16. Service Availability
DigitalXLR may experience downtime, maintenance, slow queues, model failures, provider outages, network errors, payment issues, storage issues, or generation delays.
We may modify, suspend, limit, or discontinue any part of the Service at any time.
We do not guarantee uninterrupted access, specific generation speed, specific model availability, permanent pricing, or permanent feature support.
17. Changes to Models and Providers
Because DigitalXLR depends on AI models and third-party systems, we may replace, upgrade, downgrade, remove, rename, or modify available models at any time.
If Seedance 2.0 or any other provider becomes unavailable, restricted, too costly, unstable, or unsuitable, we may replace it with another provider or internal system.
You agree that your purchase is for access to DigitalXLR’s Service, not guaranteed lifetime access to any specific third-party model.
18. Intellectual Property of DigitalXLR
DigitalXLR owns the Service, website design, software, code, systems, workflows, branding, logos, interface, documentation, pricing structure, credit system, and platform materials.
You may not copy, modify, distribute, resell, reverse engineer, scrape, clone, or create competing services based on DigitalXLR’s platform, except where allowed by law.
No rights are granted to you except the limited right to use the Service according to these Terms.
19. Copyright Complaints
If you believe content on DigitalXLR infringes your copyright or intellectual property rights, contact us with enough information to identify the content and your rights.
Your notice should include your name, contact information, a description of the copyrighted work, the allegedly infringing content, the relevant URL or file location, and a statement that you believe the use is unauthorized.
We may remove or restrict content that appears to infringe rights, and we may suspend repeat infringers.
20. Likeness, Voice, and Identity Rights
You may not upload, clone, imitate, or generate a person’s face, body, voice, identity, performance, or likeness unless you have the legal right and consent to do so.
This applies to private individuals, customers, influencers, celebrities, public figures, employees, creators, and minors.
You are solely responsible for obtaining releases, permissions, licenses, and approvals before using any person’s likeness or voice in Input or Output.
DigitalXLR may block, remove, or restrict identity-based generations at any time.
21. Commercial Use
You may use Output commercially only if your Input, Output, and final use comply with these Terms, applicable law, third-party provider terms, intellectual property rights, privacy rights, publicity rights, advertising rules, and platform policies.
You are responsible for ensuring that Output is safe and lawful for ads, social media, client work, resale, distribution, or publication.
DigitalXLR does not provide legal clearance, copyright clearance, music clearance, actor releases, model releases, trademark clearance, or advertising approval.
22. Platform and Social Media Rules
If you publish Output on TikTok, Instagram, YouTube, Facebook, X, LinkedIn, marketplaces, ad networks, or other platforms, you are responsible for following their rules.
Some platforms require AI-generated content labels, synthetic media disclosures, political content disclosures, copyright clearance, music licensing, or likeness consent.
DigitalXLR is not responsible if your content is rejected, demonetized, removed, shadowbanned, restricted, or penalized by another platform.
23. Moderation and Enforcement
We may review prompts, uploads, generations, account activity, payment activity, or usage patterns to enforce these Terms, prevent abuse, improve safety, comply with law, or protect the Service.
We may block prompts, reject uploads, remove content, reduce access, suspend accounts, terminate accounts, limit credits, or refuse service.
We are not required to provide detailed explanations for moderation decisions where doing so could compromise safety, security, provider rules, or abuse prevention.
24. Beta and Experimental Features
Some DigitalXLR features may be experimental, unstable, or in beta.
Beta features may produce unexpected results, fail more often, change without notice, consume credits differently, or be removed at any time.
You use beta features at your own risk.
25. Privacy
Your use of the Service is also governed by our Privacy Policy.
By using DigitalXLR, you agree that your Input, Output, account information, payment metadata, usage data, and technical data may be processed as described in the Privacy Policy.
You understand that third-party providers may process certain data where required to provide generation, hosting, payment, security, analytics, or support services.
26. Security
You may not attempt to hack, disrupt, overload, scan, probe, bypass, reverse engineer, or interfere with DigitalXLR or its providers.
You may not use automated systems, bots, scripts, or scraping tools without written permission.
You may not exploit bugs, unauthorized endpoints, leaked keys, payment errors, or system misconfigurations.
If you discover a security issue, you should report it responsibly and avoid accessing or modifying data that does not belong to you.
27. Suspension and Termination
We may suspend or terminate your account if you violate these Terms, create legal risk, abuse the Service, misuse payments, submit prohibited content, infringe rights, threaten users, attack the platform, or harm DigitalXLR’s operations.
After termination, you may lose access to your account, credits, generations, uploads, exports, subscription benefits, and stored files.
Sections concerning ownership, payments, refunds, prohibited conduct, disclaimers, liability, indemnity, and governing law will continue after termination.
28. Disclaimers
The Service is provided “as is” and “as available.”
DigitalXLR makes no warranties that the Service will be uninterrupted, error-free, secure, accurate, lawful for your intended use, compatible with every platform, or able to generate the exact result you want.
We disclaim all warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and reliability.
29. Limitation of Liability
To the maximum extent permitted by law, DigitalXLR will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
This includes lost profits, lost revenue, lost data, lost business, lost opportunities, reputational harm, platform bans, failed campaigns, rejected ads, copyright claims, provider outages, generation failures, or unsatisfactory Output.
To the maximum extent permitted by law, DigitalXLR’s total liability for any claim will not exceed the amount you paid to DigitalXLR in the three months before the claim arose.
30. Indemnity
You agree to defend, indemnify, and hold harmless DigitalXLR, its owners, employees, contractors, partners, service providers, and affiliates from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service.
This includes claims related to your Input, Output, commercial use, copyright infringement, trademark infringement, privacy violation, publicity rights violation, illegal content, payment disputes, breach of these Terms, or misuse of the Service.
31. Changes to These Terms
We may update these Terms from time to time.
The updated version will be posted on DigitalXLR.com with a new “Last Updated” date.
Your continued use of the Service after changes are posted means you accept the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service.
32. Governing Law
These Terms are governed by the laws of Malaysia, unless another jurisdiction is required by applicable consumer protection law.
Any dispute relating to these Terms or the Service will be handled by the courts of Malaysia, unless applicable law requires otherwise.

34. Entire Agreement
These Terms, together with any Privacy Policy, Refund Policy, pricing page, plan terms, or additional written terms shown during purchase, form the entire agreement between you and DigitalXLR regarding the Service.
If any part of these Terms is found invalid or unenforceable, the remaining sections will continue to apply.
